Shopify & patent infringement, the Canadian e-commerce giant,

has emerged victorious in a significant patent infringement lawsuit. According to Bloomberg Law, a U.S. judge has ruled the patents at the center of the case to be invalid.  The ruling came from the U.S. District Court for the Central District of California, where Judge Hernán Vera presided over the case. The patents, owned by DKR Consulting, were found to be ineligible for protection under U.S. patent law.

 

DKR Consulting had accused Shopify of infringing on four of its e-commerce patents,

which pertained to social media retail technology. These patents included innovations like an embeddable buy button and the integration of e-commerce stores within social media platforms. DKR claimed that Shopify was utilizing these technologies without proper authorization.  The patents in question were initially owned by DIY Media. Shopify and DIY Media had engaged in discussions about potential business collaborations between 2011 and 2015. DKR Consulting alleged that Shopify acquired technical knowledge of the patents during this period, which subsequently led to the alleged infringement.

 

In March 2023, Shopify filed a motion to dismiss the patent infringement lawsuit.

The company argued that the patents were too abstract to qualify for protection. Shopify’s legal team cited the U.S. Supreme Court’s decision in the Alice Corp v CLS Bank International case. This landmark ruling requires that an invention must include additional elements that make it eligible for a patent beyond merely presenting an abstract idea.

 

Judge Vera sided with Shopify’s argument,

stating that the patents did not contribute any advancements to computer functionality. Instead, they merely described a generic process of online communication between servers and devices. “The idea of enhancing web widgets does not constitute an advance in computer functionality,” Judge Vera stated.  Legal representation for DKR Consulting was provided by Daignault Iyer and Perkowski Legal, while Shopify was represented by Wilmer Cutler Pickering Hale and Dorr.

 

This isn’t the first time Shopify has faced patent infringement allegations.

In May 2024, Reuters reported another legal victory for Shopify when a U.S. federal court in Delaware overturned a jury’s decision that had previously ordered the company to pay $40 million for patent infringement.  The recent ruling in favor of Shopify underscores the company’s robust legal strategy and its ability to successfully defend against patent infringement claims. By invalidating the patents held by DKR Consulting, the court has not only cleared Shopify of wrongdoing but also set a precedent that could influence future cases involving similar patent disputes.
