Notices and communications to ELG must be sent to the applicable methods given in these Terms of Use or through www.edisonlawgroup.com. All notices, authorizations, and requests shall be deemed given on receipt.

Changes
ELG may modify these Terms of Use from time to time, and each such modification is effective upon posting by ELG on the Website. You agree to be bound to any changes to these Terms of Use when you use the Website or the Service after the modification is posted. It is therefore important that you review these Terms of Use regularly to ensure you are aware of any changes.

These Terms of Use, including the documents referenced in these terms as well as any other terms and conditions provided to you by ELG when using certain features of the Website or Service, are the entire agreement between you and ELG regarding the Website and the Service. These conditions will supersede any terms and/or conditions you include with any service agreed upon, regardless of whether ELG signs them or not.

ELG is an Intellectual Property law firm. ELG helps clients with Patents, Trademarks, Searches, Prosecution, TTAB, Cease & Desist, Copyrights, Website Disclaimers, Terms of Use, Privacy Policies, LLC & Corps.

Third Party Sites
This Website and the Service may contain links to or from other sites on the Internet that are owned and operated by third parties, including third parties with whom ELG has a contractual affiliation or strategic relationship. You acknowledge that ELG is not responsible for the operation of or content located on or available through any such site. Your use of such third party sites, and products and services available through such sites, is governed by the applicable terms of such third party.

Proprietary Rights
This Website and the Service are owned and operated by ELG. Unless otherwise specified, all materials appearing on this Website, including the text, site design, logos, graphics, as well as the selection, assembly and arrangement thereof, are the sole property of ELG and its licensors. In addition, you will not view, copy, or procure content or information from this website by automated means (such as scripts, bots, spiders, crawlers, or scrapers) unless formally authorized by ELG under separate written agreement. No materials from this Website or the Service may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without ELG’s prior written permission. All rights not expressly granted herein are reserved. Any unauthorized use of the materials appearing on this Website may violate copyright, trademark, and other applicable laws, and could result in criminal or civil penalties.

ELG agrees not to share or sell your personal information to any third party. You agree not to use the Website or Service in any way other than what is deemed appropriate by us, including for any illegal purposes. You further agree not to attempt to gain unauthorized access to ELG’s computer systems or to interfere with the servers or networks connected to the Website or Service. Any other use of the Service or information will not be allowed without ELG’s prior written consent.

Age and Residence Requirements
You must be 18 years of age or older to view the ELG website or apply for our Service.

Payments/Processing
Any person who desires to use any Service must have a confirmed credit or debit card, check, or money order, to make payments to ELG. ELG accepts Visa, MasterCard and American Express. ELG will make reasonable efforts to process your transactions in a timely manner. Payments will be taken according to the schedule you sign in the ELG Client Agreement. ELG makes no guarantees regarding the processing time for charges. All fees collected will be placed in the firms IOALTA / attorney trust account.

Credit Cards
We accept all major credit cards. Where your billing address is requested in the Client Agreement, please be sure to provide the address and phone number your financial institution has on record, as well as the card’s CVV (card security code) and expiration date. Incorrect information will likely cause a delay or failure in processing your file.

No Guarantees
ELG makes no guarantees in regards to intellectual property services. Patent and trademark application approvals are solely up to the discretion of the USPTO. ELG will never discourage communication between clients or users of the “website” and their previously appointed lawyer. Any and all information on the website is NOT legal advice. Please consult with an attorney if you are trying to seek legal advice. The sole purpose of the services of ELG and its “website” is for Intellectual Property services only. ELG and its “website” are in compliance with all State and Local advertising laws.

SMS Terms and Conditions

1. Introduction

Thank you for utilizing Edison Law Group’s SMS service. By opting into our SMS notifications, you manifest assent to the following Terms and Conditions (“T&C”), which govern your use of our SMS communications. These terms and conditions are subject to change and such changes will be posted on our website. Accordingly, you agree to be bound to those changes as they are published.

This service complies with the General Data Protection Regulation (GDPR) in the EU and the Telephone Consumer Protection Act (TCPA) & California Consumer Privacy Act (CCPA) in the US. To the extent legally allowable, you agree that any dispute arising out of issues related to this service is to be resolved in Washington, DC, under US local and federal statutes.

By subscribing, you acknowledge that you:

• Are above the age of 18 or above any relevant age of majority in your jurisdiction and that you are at least 16 years old (EU) or 18 years old (US).
• Have provided explicit consent to receive SMS messages from Edison Law Group.
• Understand you can withdraw consent at any time. Consent can be withdrawn by unsubscribing in the manner listed below.

If you do not agree with these Terms, please do not subscribe or contact info@edisonlawgroup.com to cancel your subscription.

2. Service Description

Our SMS service may include but is not limited to the following types of messages:

• Promotional messages: Offers, discounts, promotions, advertisements, and marketing updates.
• Transactional messages: Relevant USPTO date and time reminders, deadlines or document submission, document transmission notifications, PTO communication notifications, order confirmations, account notifications, and service alerts.
• Customer support: Requests for communication regarding pending applications, contact from paralegals, attorneys, or other Edison Law Group professionals, other assistance and follow-ups regarding Edison Law Group services.

Edison Law Group may charge service fees for legal professional time spent providing customer-specific services via SMS messages but will not charge for SMS messages otherwise. Additionally, carrier message and data rates may apply.

3. User Consent & Opt-In

By subscribing to our SMS service, you provide explicit opt-in consent. Subscription to our SMS services takes place by filling out an online form. Accordingly, by utilizing the service you have provided specific opt-in consent to these terms and conditions both as currently extant and as may potentially be updated in the future.

4. Opt-Out & User Rights

You can unsubscribe at any time by emailing a request to info@edisonlawgroup.com, at which point you will be unsubscribed from our SMS communications as soon as possible.

Edison Law Group respects individual privacy and honors data protection rights and endeavors to provide all services in compliance with regimes both in the United States and European Union. Users have the responsibility to ensure they are in compliance with requirements of their individual jurisdictions and Edison Law will to the extent possible facilitate legal compliance. All disputes arising from the agreement are to be settled under US Law in Washington, DC. Under the GDPR (EU) and CCPA (US), users have certain rights which Edison will ensure are protected in the carrying out of SMS services. Users have the right to:

• Access: Users may at any time request access to or have an accounting of all personal information stored by Edison Law Group.
• Correct or delete data: If a user so requests, they may have their personal information either updated to ensure its correctness or deleted from our database unless we are under legal obligation to retain the data such as when so done at the behest of law enforcement.
• Restrict processing of your data.
• Request data portability. Edison Law Group will port user data to other potential users per verified user requests.

5. Privacy & Data Protection

Edison Law Group respects privacy rights. To that end, we employ high-quality privacy protections, including the following:

• Your phone number and consent record are stored in encrypted systems.
• We do not share, sell, or otherwise allow third parties access to your data for marketing or any other purposes.
• We retain consent records for 5 years (US TCPA) or as required under EU GDPR.

In the event of any data breach, we will notify affected users within 72 hours (EU GDPR) or as required by US law. That notification will come in the manner of our choice and will be communicated to the contact information given to Edison Law Group by the user.

6. Limitation of Liability

To the extent permitted by law, Edison Law Group disclaims all liability for any damages caused by the use of our SMS service. These damages may include but are not limited to the following:

• Delayed, undelivered, or misdirected messages due to carrier issues.
• Any fees incurred from your mobile provider.
• Unauthorized access to your phone or SMS messages.
• Issues with user intellectual property rights enforcement/protection.

Our SMS service is provided “as is.” There is no guarantee that our SMS services will inform you of any relevant dates such as deadlines at the USPTO, and there is no guarantee availability of attorneys or other legal staff to respond to SMS communications. Neither does the existence of SMS service relieve the duty of all those with intellectual property interests to be consciously aware of relevant dates, requirements, and deadlines and to be responsive to the requirements associated with those dates and deadlines.

7. Changes to These Terms

We may update these Terms periodically. Updates will be posted on our website.
